Agreement to Terms

By booking photography services with Love Journal Photography ("we," "our," or "us"), you ("the Client") agree to be bound by these Terms of Service. Please read these terms carefully before making a booking.

Booking and Payment

Booking Process

To secure your booking, you must:

1. Complete our booking inquiry form or contact us directly
2. Review and accept the quote provided
3. Pay the required deposit within 7 days of booking
4. Sign the photography agreement

Deposit Requirements

A non-refundable deposit of 20% of the total package price is required to secure your booking. This deposit is applied toward your total service cost.

All payments must be received at least 14 days before your wedding date.

Accepted Payment Methods

• Bank transfer (preferred)
• Cash

Cancellation Policy

Client Cancellation

If the Client cancels the booking:

• 60+ days before wedding: Full refund minus non-refundable deposit
• 30-60 days before: Deposit non-refundable, may transfer to future date within 12 months
• Less than 30 days: Full payment non-refundable

Transfer to New Date

If you need to change your wedding date:

• New date must be within 12 months of original date
• New date is subject to availability
• A $200 transfer fee applies
• Price difference may apply if package costs change

Photographer Cancellation

In the rare event that we cannot fulfill your booking:

• We will provide a full refund if no suitable replacement is found
• We will attempt to find a qualified replacement photographer of comparable skill
• We are not responsible for any additional costs incurred by the Client

Service Terms

Coverage and Hours

Our standard wedding packages include:

• Agreed number of hours as specified in your package
• One photographer (or two for packages specifying dual coverage)
• Travel within Melbourne metropolitan area
• Online delivery of edited digital images

Additional Hours

Additional hourly coverage may be available at the following rates:

• Additional photographer: $250/hour
• Additional hours beyond package: $200/hour

Travel and Destination Fees

For locations outside Melbourne metropolitan area:

• Travel within 50km of Melbourne CBD: No additional charge
• Travel 50-100km from CBD: $150 travel fee
• Travel beyond 100km: Quoted individually
• International destinations: Quoted individually

Delivery of Images

Delivery Timeline

We aim to deliver your wedding images within the following timeframe:

• Preview images: Within 5-7 business days (30-50 highlight images)
• Full gallery: Within 4-6 weeks of your wedding date
• Album designs: Within 8 weeks of receiving image selection

Delivery Method

All images are delivered via:

• Private online gallery
• High-resolution download capability
• Print release for personal use

Image Selection

The photographer will select and edit images based on technical quality and artistic judgment. We do not provide raw/unedited files. Image selection is not available for standard packages but may be arranged for an additional fee.

Intellectual Property and Usage Rights

Copyright

Copyright of all images remains with Love Journal Photography. The Client is granted a license to use images for personal, non-commercial purposes.

Client Usage Rights

The Client may:

• Download and print images for personal use
• Share images on personal social media accounts (with credit where possible)
• Create prints for personal display
• Use images in personal blogs and websites

Commercial Usage

Commercial use of images (advertising, publications, commercial websites) requires written permission and may incur additional fees.

Photographer Usage

Love Journal Photography retains the right to use images for:

• Portfolio display on website and social media
• Marketing and advertising materials
• Photography competitions and publications
• Industry publications and exhibitions

Clients who prefer images not be used for marketing may opt out in writing.

Liability and Indemnification

Limitation of Liability

Love Journal Photography's liability is limited to the total amount paid by the Client. We are not liable for:

• Any indirect, consequential, or incidental damages
• Loss of profits, data, or business opportunities
• Any damages arising from circumstances beyond our reasonable control

Force Majeure

We are not liable for failure to perform obligations due to events beyond our reasonable control, including but not limited to natural disasters, illness, injury, or transportation disruptions.

Indemnification

The Client agrees to indemnify and hold Love Journal Photography harmless from any claims, damages, or expenses arising from the Client's use of the images.

Model Release

By booking our services, the Client grants Love Journal Photography permission to use images for promotional purposes unless explicitly stated otherwise in writing. All photographed individuals grant permission for their images to be used as described.

Complaints and Disputes

If you have any concerns about our service, please contact us immediately to discuss. We aim to resolve all disputes amicably and to the satisfaction of all parties.

Changes to Terms

We reserve the right to modify these terms at any time. Any changes will be effective immediately upon posting to our website. Your continued use of our services constitutes acceptance of any modified terms.

Governing Law

These terms are governed by the laws of Victoria, Australia. Any disputes will be resolved in the courts of Victoria.

Frequently Asked Questions

What is your cancellation policy?

If you cancel more than 60 days before your wedding, you will receive a full refund minus the deposit. If you cancel 30-60 days before, the deposit is non-refundable but may be transferred to a future date. Cancellations within 30 days are non-refundable.

What happens if you cannot attend our wedding?

In the rare event that we cannot attend due to illness or emergency, we will arrange a qualified replacement photographer from our network. If no replacement is available, you will receive a full refund.

Do I get the raw files?

No, we do not provide raw/unedited files. All delivered images have been professionally edited for color, contrast, and composition.

How long do you keep our images?

We retain backup copies of your images for a minimum of 12 months after delivery. After this period, we cannot guarantee image availability.
